These Terms & Conditions ("Terms") govern your purchase and use of Cypress ("we", "us", "our"), operated by John Stark, a sole trader based in New Zealand. By purchasing or using our products or services you agree to these Terms. If you do not agree, do not purchase or use the service. You can reach us any time at hello@aicypress.xyz.
1. What we provide
Cypress is a software tool that benchmarks how often a brand is recommended by large language models (LLMs) such as ChatGPT, Claude, Gemini and Perplexity, classifies why those mentions occur, and tracks how they change over time. We also offer a one-time LLM SEO optimization consultancy in which we review your project and provide recommendations.
2. Products & pricing
All prices are in USD and are one-time charges:
- LLM SEO Optimization Consultancy — $199 USD (one-time): a one-off engagement where we audit your current AI brand visibility and deliver a prioritized improvement plan.
- Lifetime Access — $899 USD (one-time): a one-off payment for ongoing access to the Cypress software, subject to the scope described in section 3.
Payments are processed securely by Stripe. We do not store or have access to your full card details. Applicable taxes may be added at checkout.
3. Scope of "Lifetime Access" — important
"Lifetime Access" is a licence to the Cypress software tool only. It does not include, and is not a substitute for, LLM usage of any kind. In particular, Lifetime Access does not include:
- LLM API calls, prompts, tokens, message credits or model usage;
- the cost of any third-party LLM provider (OpenAI, Anthropic, Google, Perplexity, etc.).
Cypress operates on a bring-your-own-key (BYOK) basis: you supply your own API keys for the LLM providers you wish to benchmark, and you are solely responsible for your own usage of, payment to, and compliance with those providers' terms. Your provider costs are billed by them directly, not by us.
We are planning a separate monthly subscription plan that may include LLM tokens/usage. If and when launched, that plan will be offered under its own pricing and terms and is not part of, or promised by, the Lifetime Access purchase.
"Lifetime" refers to the operational lifetime of the Cypress product and service. It is not a guarantee that the software will be operated indefinitely. If we ever discontinue the product entirely, we will give reasonable notice and, where practical, a means to export your data.
4. Refunds & cancellations
- Consultancy ($199 USD): you may cancel for a full refund at any time before we begin work. Once we have begun the audit/analysis, the fee is non-refundable as the service has been substantially delivered.
- Lifetime Access ($899 USD): because this is a digital product delivered immediately, it is non-refundable once access has been granted.
To request a refund or cancellation, email hello@aicypress.xyz with your order details. Nothing in this policy limits any non-excludable rights you may have under the consumer laws of New Zealand.
5. Acceptable use & licence
We grant you a non-exclusive, non-transferable licence to use Cypress for your own personal or single-business use. You may not resell, redistribute, sublicense, or share access to the software, nor use it unlawfully or to infringe others' rights. You are responsible for keeping your account credentials and API keys secure.
6. Disclaimers & limitation of liability
Cypress is provided on an "as is" and "as available" basis. AI model outputs are probabilistic and change over time; we do not guarantee any particular mention rate, visibility result, ranking, or commercial outcome. To the maximum extent permitted by law, our total liability arising out of or relating to the products or services is limited to the amount you paid us for the product or service giving rise to the claim. We are not liable for indirect or consequential loss, or for third-party LLM provider costs, outages or decisions.
7. Third-party services
The service relies on third parties including LLM providers and our payment processor, Stripe. Your use of those services is also subject to their terms and privacy policies. We are not responsible for the acts, omissions or pricing of third parties.
8. Changes to these Terms
We may update these Terms from time to time. Material changes will be reflected by the "Last updated" date above. Continued use after changes constitutes acceptance.
9. Governing law
These Terms are governed by the laws of New Zealand, and the courts of New Zealand will have jurisdiction over any dispute.
