These Terms & Conditions ("Terms") govern your access to and use of Cypress ("we", "us", "our"), operated by John Stark, a sole trader based in New Zealand. By subscribing to or using the service, you agree to these Terms. If you do not agree, do not use the service. You can reach us at [email protected].
1. What we provide
Cypress is an AI recommendation analytics platform for B2B SaaS startups. It benchmarks how strongly AI assistants such as ChatGPT, Claude, Gemini and Perplexity recommend a startup, explains which sources and competitors influence those recommendations, and tracks visibility trends over time.
2. Subscription pricing
Cypress offers a free plan with no credit card required. Paid subscription prices are in USD:
- Cypress Pro Monthly — $39/month: monthly access to the Cypress platform.
- Cypress Pro Annual — $390/year: annual access to the Cypress platform at a reduced effective rate.
Payments are processed securely by Stripe. We do not store or have access to your full card details. Applicable taxes may be added at checkout.
3. Subscription scope
Your subscription gives you access to the software features available in your plan, which may include Recommendation Score reporting, multi-model benchmarking, prompt-library access, competitor analysis, source intelligence, category visibility analysis and exportable reports.
Supported models, benchmark limits, prompt coverage and reporting features may change as the product evolves. Third-party LLM providers can change their models, outputs, pricing, availability or policies at any time.
4. Cancellations & refunds
You may cancel your subscription at any time. Cancellation stops future renewals but does not automatically refund fees already paid for the current billing period unless required by law or agreed by us in writing.
To request cancellation or billing support, email [email protected] with your account details. Nothing in this policy limits any non-excludable rights you may have under the consumer laws of New Zealand.
5. Acceptable use & licence
We grant you a non-exclusive, non-transferable licence to use Cypress for your own business purposes. You may not resell, redistribute, sublicense, share access unlawfully, interfere with the service, reverse engineer the software, or use the service to infringe others' rights.
You are responsible for keeping your account credentials secure and for all activity that occurs through your account.
6. Disclaimers & limitation of liability
Cypress is provided on an "as is" and "as available" basis. AI model outputs are probabilistic and change over time; we do not guarantee any particular Recommendation Score, visibility result, ranking, recommendation outcome or commercial result. To the maximum extent permitted by law, our total liability arising out of or relating to the service is limited to the amount you paid us in the three months before the claim. We are not liable for indirect or consequential loss, or for third-party provider costs, outages or decisions.
7. Third-party services
The service relies on third parties including LLM providers, hosting providers and our payment processor, Stripe. Your use of those services may also be subject to their terms and privacy policies. We are not responsible for the acts, omissions, availability or pricing of third parties.
8. Changes to these Terms
We may update these Terms from time to time. Material changes will be reflected by the "Last updated" date above. Continued use after changes constitutes acceptance.
9. Governing law
These Terms are governed by the laws of New Zealand, and the courts of New Zealand will have jurisdiction over any dispute.
